Welcome to Medic I.D Australia.
Medic I.D Australia is operated by Impulse Purchase Specialists (ABN 84 082 123 591), trading as Medic I.D Australia. The terms “we”, “us” and “our” refer to Medic I.D Australia.
We operate this website and online store, including the information, content, features, tools, products and services made available through it (collectively, the “Services”). Our online store is powered by Shopify.
These Terms of Service (“Terms”) describe the terms and conditions that apply when you access our website, use our Services or purchase products from us.
By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable Australian law.
1. ACCESS AND ACCOUNTS
By using our Services, you represent that you are legally capable of entering into a binding agreement or that you are using the Services with the involvement and consent of a parent or legal guardian where required.
When using our Services or placing an order, you may be required to provide information including your name, email address, telephone number, billing information, shipping address, medical engraving information and payment information.
You agree that the information you provide is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
2. OUR PRODUCTS
Medic I.D Australia supplies medical identification jewellery and related products, including medical ID bracelets, pendants, dog tags, keyrings and personalised products.
We make reasonable efforts to accurately represent our products, including their appearance, dimensions, materials and colours. However, product colours and appearance may vary slightly depending on your device, screen settings, photography and manufacturing variations.
Product descriptions, availability and specifications may be updated from time to time.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
3. MEDICAL ID PRODUCTS AND INFORMATION
Our medical ID products are intended to provide a convenient means of displaying information selected by the customer.
Medic I.D Australia does not provide medical advice. Information appearing on our website concerning medical conditions, allergies, medications, emergency information or suggested engraving is general information only.
You are responsible for determining what information should be engraved on your medical ID product. If you are unsure what medical information should appear on your medical ID, you should seek advice from an appropriately qualified healthcare professional.
A medical ID product is not a substitute for professional medical care, diagnosis, treatment, emergency services or other appropriate medical precautions.
We do not guarantee that a medical ID product will be noticed, read or acted upon by a healthcare professional, first responder or another person in an emergency.
Nothing in this section limits any rights or remedies you may have under applicable law.
4. PERSONALISATION AND ENGRAVING
Many Medic I.D Australia products can be personalised with information supplied by the customer.
You are responsible for checking all engraving information carefully before submitting your order, including:
- names;
- medical conditions;
- allergies;
- medications;
- emergency contact information;
- telephone numbers;
- spelling, punctuation and abbreviations; and
- any other information submitted for engraving.
We will generally engrave the information according to the details supplied with your order, subject to available engraving space, technical requirements and product limitations.
We may contact you if engraving instructions appear unclear, exceed the available engraving area or cannot reasonably be completed as requested.
Because personalised and engraved products are made or altered specifically for you, change-of-mind cancellations, returns or exchanges may not be available once personalisation or engraving has commenced.
However, this does not exclude or limit any rights you may have under the Australian Consumer Law, including remedies that may apply where goods are faulty, damaged, not as described or otherwise fail to satisfy an applicable consumer guarantee.
If we make an engraving error that differs materially from the engraving information you correctly supplied, please contact us so that we can assess and resolve the issue.
5. ORDERS
When you place an order, you are making an offer to purchase the products in your order.
We reserve the right to accept or decline an order where reasonably necessary, including where a product is unavailable, pricing or product information contains an error, payment cannot be processed, we reasonably suspect fraud, or we cannot fulfil the requested personalisation.
Payment must be successfully processed before an order can be fulfilled.
Please review your order and engraving instructions carefully before submitting them.
Once engraving or personalisation has commenced, we may be unable to change or cancel the order.
If we cannot accept or fulfil your order, we will make reasonable efforts to contact you using the details supplied with your order and, where appropriate, arrange a refund.
Returns, refunds and exchanges are also subject to our Return and Refund Policy and your rights under Australian Consumer Law.
6. PRICES AND PAYMENT
All prices displayed on our Australian website are in Australian dollars unless otherwise stated.
Prices, promotions and discounts may change from time to time.
The amount payable will be displayed during checkout before you complete your purchase.
Shipping or other applicable charges will be disclosed during checkout where applicable.
You agree to provide accurate and authorised payment information when making a purchase.
7. SHIPPING AND DELIVERY
We offer delivery to eligible locations using the shipping options displayed at checkout.
Any delivery timeframes displayed on our website are estimates unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, public holidays and other disruptions.
Please ensure that the delivery address supplied with your order is complete and accurate.

Nothing in this section excludes any rights or remedies available to you under applicable law.
8. RETURNS AND REFUNDS
Returns, refunds and exchanges are handled in accordance with our Return and Refund Policy and applicable Australian law.
Personalised or engraved products generally cannot be returned simply because you change your mind once personalisation has commenced.
This change-of-mind restriction does not affect rights and remedies available under the Australian Consumer Law where applicable, including in relation to goods that are faulty, damaged, unsafe, not as described or otherwise fail to comply with a consumer guarantee.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through our Services, including our branding, text, graphics, photographs, product imagery, logos, website design and other materials, is owned by or licensed to Medic I.D Australia and is protected by applicable intellectual property laws.
You may use our website for your personal, non-commercial use.
You must not reproduce, distribute, republish, commercially exploit or materially modify our content without our permission, except where permitted by law.
Third-party names, trademarks and intellectual property remain the property of their respective owners.
10. THIRD-PARTY SERVICES AND LINKS
Our Services may contain links to or functionality provided by third parties.
We are not responsible for the content, privacy practices, availability or operation of third-party websites or services that are outside our control.

11. SHOPIFY
Our online store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our online store. Purchases made through our store are transactions between you and Medic I.D Australia, not Shopify.
Shopify may process certain information in connection with providing its ecommerce services. Further information about the handling of personal information is available in our Privacy Policy and Shopify's applicable privacy documentation.
12. PRIVACY
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
Because our store is hosted using Shopify, certain information may also be processed by Shopify and other service providers that assist us in operating our website, processing orders, accepting payments, delivering products, providing analytics and communicating with customers.

13. FEEDBACK AND REVIEWS
If you submit a review, suggestion, comment or other feedback to us, you confirm that you have the right to provide that content.
You must not submit content that is unlawful, misleading, defamatory, abusive, infringing or otherwise inappropriate.
Subject to applicable law, you grant us permission to use feedback or reviews you voluntarily provide for legitimate business purposes, including displaying and promoting customer feedback.
14. ERRORS AND INACCURACIES
Occasionally our website may contain errors or omissions relating to product descriptions, availability, pricing, promotions, shipping charges or other information.
Where permitted by law, we may correct errors or update information when identified.
If an error materially affects an order you have already placed, we will take reasonable steps to contact you and provide an appropriate resolution.

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, any additional warranties or representations not expressly stated by us are excluded.
17. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded or limited under the Australian Consumer Law.
To the extent permitted by law, we are not responsible for indirect or consequential loss arising from circumstances outside our reasonable control.
Our medical ID products are intended to display customer-selected information. We do not guarantee that a medical ID product will prevent injury, illness, medical complications or other adverse outcomes, or that it will be noticed or relied upon during an emergency.
This section is subject at all times to your non-excludable rights under applicable Australian law.
18. INDEMNITY
To the extent permitted by law, you agree to indemnify Medic I.D Australia against reasonable loss arising directly from your unlawful use of our Services or your material breach of these Terms.
This provision does not apply to the extent that loss was caused or contributed to by us, nor does it limit rights that cannot lawfully be excluded.
19. TERMINATION
We may suspend or terminate access to our Services where reasonably necessary, including where these Terms have been materially breached or where unlawful or fraudulent activity is reasonably suspected.
Termination does not affect rights or obligations that accrued before termination or provisions that by their nature continue after termination.
20. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be treated as modified or severed to the extent necessary, and the remaining provisions will continue to apply.
21. WAIVER AND ENTIRE AGREEMENT
A failure or delay by us to exercise a right under these Terms does not constitute a waiver of that right.
These Terms, together with policies incorporated or referred to in them, govern your use of our Services and purchases from our online store, subject always to applicable law.
22. GOVERNING LAW
These Terms are governed by the laws applicable in New South Wales, Australia and the laws of the Commonwealth of Australia that apply in New South Wales.
You and Medic I.D Australia submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.
Nothing in this section limits any rights you may have regarding jurisdiction or venue under applicable consumer law.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, Services or applicable requirements.
The current version will be made available on our website.
Changes will apply from the date the updated Terms are published, subject to applicable law. Changes will not retrospectively remove rights that have already accrued.
